Richmond Casino Case
At 10 a.m. on August 15, at the John Marshall Courthouse in Richmond, Judge William Marchant granted a hearing on the motion to intervene filed by a group challenging the Richmond casino plan that’s represented by State Senator Chap Peterson. The hearing will be at 10am in Richmond Circuit Court at the John Marshall Courts Building at 400 North Ninth Street in Richmond this morning.
Though the casino has this legal challenge that challenge could go away as early as today. A referendum vote on the Richmond casino is scheduled to be on the ballot this November (early voting begins in 38 days).

Board of Elections to Decide on Berry, Lipscomb?
At 1 p.m. today the Virginia Board of Elections will meet in Senate Room A at the Pocahontas Building at 900 E. Main Street in Richmond. Will they hear the cases of Democrat Trudy Berry, who is trying to make the ballot against Republican Frank Ruff, and Jasmine Lipscomb, who is trying to make the ballot against Republican Danny Marshall?

Berry and Jasmine Lipscomb have requested to be on the agenda but the agenda as seen last night does not indicate they will be heard.. Elizabeth Burneson is Trudy Berry’s attorney.
BACKGROUND: Trudy Berry, Democratic candidate for Senate District 09, did not make the ballot in her run for State Senate against Republican Frank Ruff though she filed all of the required paperwork to the Board of Elections and state party officials. But a local party official sent Berry’s paperwork to the wrong email address and she has been blocked from the ballot as a result of that mistake. (See e-mail below as found via a FOIA request filed by Activate Virginia’s Josh Stanfield).
There were five people who had the same issue in two election cycles that Trudy Berry is having this year: Local committees failed to file the paperwork correctly, but the Board of Elections put the candidate(s) on the ballot anyway. They were:
2019: Terry Kilgore (R) and Clint Jenkins (D)
2021: Dave LaRock (R), Matt Lang (R), and Gina Ciarcia (R)
There have been several “paperwork snafus” this cycle. At a time democracy is on the as Donald Trump and his MAGA supporters are talking openly about dismantling the federal government, the FBI and the election systems, Democrats in Virginia are attempting to keep control of the Virginia Senate and win back the Virginia House. Whether the “paperwork snafus” of 2023 will matter will not be known until Election Day November 7, 2023.
Below is a list of Republicans who will automatically win because of Democratic party “paperwork snafus” this cycle (assuming the Berry/Lipscomb issues are not addressed):
SD09 — Trudy Berry (Republican Frank Ruff)
SD10 — Dan Tomlinson (Republican John McGuire) … after Jacob Boykin filed his paperwork but another candidate was selected and didn’t file his certificate of candidate qualification (CCQ or 501) statement of economic interest (SOEI).
HD39 — Greg Maxwell (Republican Will Davis)
HD49 — Jasmine Lipscomb (Republican Danny Marshall)
HD98 — Zach Coltrane (Republican Barry Knight)
HD74 — Jessica Rowland (Republican Mike Cherry)
The error regarding the Trudy Berry “paperwork snafu” was noted in an e-mail (seen below) among state party officials and Virginia Department of Elections Commissioner Susan Beals. Clem Oliver🌹🌹 who had long been ill and who sadly passed away on July 19, was assisted by Patricia Harper Tunley. A second candidate, Jasmine Lipscomb, who is also trying to get on the ballot against Republican Danny Marshall, also experienced a “paperwork snafu” in the same area.
